GENERAL TERMS OF AGREEMENT
GT.1 These Terms and Conditions is an agreement between you (the Buyer, You) and the company running the Boardside.lv shop:

(Boardside.lv, us; together – the Parties and each the Party) on your use of Boardside.lv website https://boardside.lv/ (Website) to place the orders.
GT.2 The Buyer confirms to have read and agrees to be bound by the Terms and Conditions as well as Boardside.lv Privacy Policy available at https://boardside.lv/en/privacy/ (Privacy Policy) when placing an order on our Website.
GT.3 If any terms agreed between the Parties may be interpreted as being in conflict with one another, the following hierarchy of precedence will be followed for purposes of interpreting and applying the provisions of terms: First - Special Terms (if any); Second - Privacy Policy; Third - Terms and Conditions. For the avoidance of doubt, the terms ranked first will take precedence over the terms ranked lower above (i.e. special terms will take precedence over Terms and Conditions).
GT.4 The Terms and Conditions may not contradict the applicable laws of the Republic of Latvia and will be complemented by the applicable legislation (in case of a dispute or insufficient information).
GT.5 The purchasing of goods from Boardside.lv is only to be done by people of the age of 18 years or older. If the Buyer is under 18 years of age or a minor in the territory where the Buyer resides, then the Buyer must not place an order at any time or in any manner. By placing an order on the Website, the Buyer affirms that either he or she is at least 18 years of age or has been authorized to place the order by his or her parent or legal guardian who is at least 18 years of age and accepts these Terms and Conditions on his or her behalf.
GT.6 Boardside.lv holds the right to unilaterally amend these Terms and Conditions and the product prices.

PLACING THE ORDER
PO.1 The Buyer selects the desired product, delivery and payment method. The order is confirmed by filling in all the required fields in the order form.
PO.2 Once the buyer has confirmed to place the order by pressing the Buy Button (moment of placing the order) the order is submitted to Boardside.lv for processing and cannot be further modified. The order shall only be processed by Boardside.lv if the entire order form has been fully completed, without any errors and includes all the necessary information, including the buyer's details.
PO.3 If Boardside.lv system accepts the order, the Buyer is issued an invoice with these Terms and Conditions and Privacy Policy included in the e-mail which is sent to the e-mail address provided by the Buyer.
PO.4 The orders placed on the Website are being reviewed within shops working hours, which may vary throughout the season. You can view the current working hours here: https://boardside.lv/en/address/
PO.5 Before paying the invoice, the Buyer should check that the details in the invoice correspond to the information provided by the Buyer.
PO.6 The Buyer shall pay the due amount provided in the invoice.
PO.7 After receiving the payment made out to SIA Enter Dizains, Boardside.lv shall send the Buyer confirmation e-mail and send out the goods via Buyers chosen delivery method.

PRICE OF GOODS
PG.1 All the prices of products on the Website are shown in euros, without delivery costs. All prices include VAT of 21%. The delivery costs will be provided upon choosing the delivery method and will be added to the total price.
PG.2 Boardside.lv retains the right to adjust the prices. If the Buyer has finalized the order before the price change, the price of the product will remain as it was at the time of confirming the order.
PG.3 Detailed information on the delivery options and prices can be found in the “Delivery”section of these Terms and Conditions.

PURCHASES
PC.1 The price or availability of goods may change without advance notification. If the Buyer placed the order before the changes occurred, the price shall remain as it was at the time of placing the order.
PC.2 If it is not possible to fulfill the order, the Buyer will be contacted via e-mail and the paid amount will be returned to the bank account used to pay for the order.
PC.3 Boardside.lv always tries to be as accurate as possible. We make sure to display the attributes of our products, including composition and colours as accurately as possible. The actual colour of the product might display slightly different, depending on the calibration of the screen you are viewing it on.
All measurements shown on the website are only approximate values to allow for a better understanding of the model or fit of that specific item, and are not a definite guarantee of the actual measurements of the item. The actual measurements of an item may vary depending on the material and manufacturing technique used in its production.

GIFT CARD
GC.1 Gift card can be purchased in person in our store at 1b Terezes street, Riga or at online store https://boardside.lv
GC.2 Gift card is valid for 6 months from the moment of purchase.
GC.3 Gift card can be used to pay for purchases in our store at 1b Terezes street, Riga or at online store https://boardside.lv
GC.4 Gift card can be used only once to pay for one purchase or order. The value of the gift card cannot be split, and any unused value will not be refunded. Gift card can be used to pay for all available products in Boardside.lv shop.
GC.5 The expiration date of the gift card can be seen on the bottom left corner at the “derīga līdz:” mark where the expiry date is hand written by the shop employee.
GC.6 If the price of the purchase exceeds the value of the gift card, the difference can be paid in cash or by card.
GC.7 Gift cards cannot be returned or exchanged for cash.
GC.8 The gift card can be passed on to any third party. It is the initial holders duty to explain all the terms of use of the gift card to the receiving party.
GC.9 If the gift card has not been used before the expiration date or is lost, it is not refunded.
GC.10 Boardside.lv does not accept damaged, unreadable or unusable gift cards and will not refund or re-issue them.
GC.11 SIA “ENTER DIZAINS” retains rights to change these terms and conditions applicable to gift cards at any moment, and shall inform about any such changes on the shops website https://boardside.lv

DELIVERY
DE.1 If the order and contact details have been filled in properly, the Buyer shall be sent an invoice at the e-mail address.
DE.2 Deliveries within the Baltic countries will be done via Omniva parcel terminals or using Omniva, DPD, Venipak, UPS, DHL courier services. For worldwide shipping Omniva, DPD, UPS, DHL, Venipak, GLS services will be used.
DE.3 Deliveries within Baltic countries usually take 3–5 working days from the payment confirmation. International deliveries usually take 5-7 working days from the payment confirmation. These times may differ depending on weather conditions and/or courier service availability.
DE.4 Delivery costs are paid by the Buyer.

• Delivery to home address within Latvia 10€ (including VAT)
• Delivery to Omniva parcel terminals in Lithuania or Estonia 7€ (including VAT)
• Delivery to home address in Lithuania or Estonia 15€ (including VAT)
• Delivery to EU countries starting from 20€ (including VAT)
• Boardside.lv does not deliver outside of European Economic Area

DE.5 Boardside.lv is responsible for the goods purchased by the Buyer during the transportation period. The risk of damage or loss transfers to the Buyer from the moment the Buyer or an authorized third party takes physical possession of the goods.
DE.6 Boardside.lv does not aim to profit from delivery costs, therefore will always try to find the most convenient and cheap method of delivery.

ORDERS AND RETURNS
OR.1 The Buyer who is a consumer (the Consumer) has the right to withdraw from the purchase contract, without providing reasons, by informing Boardside.lv within 14 days from the day when the goods were delivered (if the Consumer had ordered several items that are delivered separately – from the day when the last of the goods has been delivered) and receive reimbursement of all the money paid for the goods, except the delivery costs.
Enter Dizains SIA / Boardside.lv is not responsible and will not cover any shipping costs due to return or exchange of purchased goods. Additional costs associated with the return or exchange of any purchased goods shall be covered by the buyer.
OR.2 To exercise the right of withdrawal, the Consumer may use the standard withdrawal application form. The Consumer must send back or hand over the goods to Boardside.lv within 14 days from the day the Consumer has informed Boardside.lv about withdrawal from the contract (clause OR.1).
OR.3 Consumers in the Baltic countries (Lithuania, Latvia, Estonia) (the Baltics) may return the goods via Omniva parcel terminals or a different shipping method of their own choosing, informing Boardside.lv beforehand and providing a valid tracking number. All return or exchange shipping is done at the expense of the Consumer.
OR.4 Boardside.lv shall reimburse the Consumer to the bank account that the Consumer originally paid from, within 14 days from receiving notice of withdrawal from the contract. Boardside.lv may delay the reimbursement until the goods have been received back or until the Consumer has supplied evidence of having sent the goods – whichever is the earliest.
OR.5 Please ensure that the returned goods are unused and in original packaging. The Consumer is liable for any diminished value of the goods resulting from the handling of the goods other than what is necessary to establish the nature, characteristics, fit and function of the goods, as if done at the shop.
OR.6 The original packaging must be opened carefully without damaging it. The Consumer shall not be held responsible for damaging the packaging only in the case that the packaging could not be opened without destroying/damaging it. If the Consumer has damaged the packaging in case where it was possible to open the packaging without damaging it, Boardside.lv is eligible to demand compensation for the caused damage.

Return in the shop
OR.7.3 Returns in the Boardside.lv shop can be done within shop working hours. The money for the goods will be reimbursed back to the account that was used for the initial purchase, within 14 days from receiving the goods back. Cash reimbursements are only possible for purchases that were made using cash payment.

PROCESSING OF THE BUYER'S PERSONAL DATA
PD.1 Boardside.lv only uses the personal data provided by the Buyer and the information of purchases in conformity with the applicable personal data processing regulation within the extent which is necessary for fulfilling the order or if there is legal basis for that. Boardside.lv may transfer the Buyer’s personal data to third parties such as companies providing the postal/courier service, within the extent that is necessary for delivering the goods to the Buyer.
PD.2 Boardside.lv processes the Buyer’s personal data in conformity with Boardside.lv Privacy Policy, which is available at https://boardside.lv/en/privacy/. For more detailed information on the processing of the Buyer’s personal data, please read the Privacy Policy or contact us on [email protected]. Warranty against defects and filing a complaint.
WA.1 Boardside.lv will inspect any and all products sent in for warranty for the period of up to two years from the original date of purchase of that product. Products determined to have a manufacturer's defect will be repaired if possible. Should a product be un-repairable, replacement is at the discretion of manufacturers Warranty Department and would be a product of equal or greater performance. Repaired or replaced items are covered for the remainder of the original warranty only.
WA. 2 Boardside.lv shall not be responsible any losses or other consequences caused by incorrect information submitted by the Buyer, including delayed delivery, if caused by circumstances outside of control of Boardside.lv.
WA.3 Boardside.lv shall not be responsible for any damage or loss due to improper use or storage of the goods.
WA.4 The Buyer may file a complaint with Boardside.lv using the afore mentioned contact details, by e-mail at [email protected] or in person at the Boardside.lv shop at 1b Terezes street, Riga, LV-1012, Latvia. In the complaint form the following information must be stated - the name and contact details of the Buyer, the date of filing the complaint, the occurred defect of goods and the content of the filed claim, and attach the document of proof of the purchase.
The complaint should be presented in writing alongside the purchased goods and the document of proof of the purchase. Warranty claim will be considered valid within the legal period of time since purchase if defects or damage has been caused by manufacturing, due to material quality or production flaws. Warranty does not cover wear and tear from normal use.

WA.6 All disputes between Boardside.lv and the Buyer shall be initially attempted to be solved by negotiations, without prejudice to any consumer rights.
WA.7 If the Buyer is a consumer, they may also submit a complaint regarding any product purchased in the online store to the following:

WA.8 All warranty claims and complaints shall be processed in accordance with the law of the Republic of Latvia and EU.
The relationship between the Parties shall be interpreted and disputes between the Parties shall be settled in accordance with the law of the Republic of Latvia in the courts of the Republic of Latvia.
In the event of non-conforming goods, a Consumer has a right to:
NC.1 Demand repair or replacement of the goods with new goods.
NC.2 Demand withdrawal from the contract, if:
NC.2.1 Boardside.lv is not able to repair or replace the goods;
NC.2.2 The repairs of the goods have been unsuccessful;
NC.2.3 Boardside.lv have not resolved the claim within reasonable amount of time;
NC.2.4 Major inconveniences have been caused to the consumer as a result of repairs or replacement.
NC.3 The Buyer also has other legal remedies, such as the right to claim damages, withdraw from the contract, demand a price reduction, or compensation in the event of a delay.
NC.4 Boardside.lv is not be responsible for the non-conformity or damage of goods in following cases:
NC.4.1 If it is caused by improper use, maintenance or storage or by repairs done by another party;
NC.4.2 If the damage has been caused by overly high stress, contact with chemicals, water or fire damage, or other circumstances beyond the control of the manufacturer.

Wetsuit & Neoprene Accessories Warranty
GENERAL WARNINGS:
• Seller is not responsible for the usage of your product. You accept that you have read all safety rules;
• Seller is not responsible for inherent risks/dangers and hazards involved with these products;
• Minors and others not able to assume this responsibility must be under the direct control of an experienced and responsible person;
• You are responsible for your own actions and decisions;
• Before using this product, read and understand all instructions and warnings that accompany it and familiarize yourself with its proper use, capabilities and limitations;
• Seek qualified instruction;
• Contact seller if you are uncertain about how to use this product;
• Do not modify this product in any way
WARRANTY DOES NOT COVER FOLLOWING:
• Wear and tear from normal use;
• Fading from exposure to sunlight;
• Damage from exposure to harsh detergents, chemicals, or fabric softeners;
• Damage caused by chlorine (degradation of the gluing in the suit is the most common chlorine-caused damage);
• Damage caused by using petroleum jelly (Vaseline) or any other petroleum-based product or unapproved lubricant, cleaner or treatment;
• Suits clearly worn out and should be retired; some symptoms include but are not limited to: Cracked, dry neoprene;
• Product has been misused or improperly cared for;
• Home repairs have been done, including but not limited to: Re-gluing of seams using Aqua Seal, or like product;
• Patching of seams using duct tape, rubber patches, or like product;
• Re-sewn seams with a sewing machine or by hand using needle and thread;
• Use in commercial, rental, teaching or instructional program or activities;
• Products that have been worked on with embroidery, printing or something as such;
• Fin cuts, fingernail cuts (stress tears);
• Stress tears (tears caused by forcefully putting on or taking your suit off to the extent that your heel, finger or anything else punctures the suit);
• Zipper detachment/Missing teeth;
• Improper handling or storage;
• Fit issues - any fit issues should be resolved before the wetsuit is used;
• Damage as a result/consequence of wrong storage;
• Damage as a result/consequence of lacking, poor or wrong maintenance.

Kite-Wake-Surf Board Equipment Warranty
GENERAL WARNINGS:
• The warranties and limitations extend only to the original purchaser or to the person for whom originally purchased;
• Proof of purchase is required from an authorised dealer. Receipt must clearly identify the dealer;
• Warranty claims are to be handled by the dealer who holds the responsibility for selling the product to the consumer. Consumers must return the product to the dealer from whom they purchased the product to make a warranty claim. It is the sole discretion of a dealer to honour the manufacturer warranty for an item they have not sold to a consumer;
• Manufacturer reserves the right to refuse warranty based on determination of defects caused by any other factor than manufacturer error.
WARRANTY DOES NOT COVER FOLLOWING:
• Tearing out of finger holes, pull straps, and laces;
• Cosmetic dings, chips, and dents;
• Normal wear and tear or abrasion of the materials;
• Damage caused by solvents, adhesives, chlorine including chlorine water, bleaches or other corrosive or damaging substances;
• Damage due to improper handling, maintenance, modification, abuse or storage;
• Product has been misused or improperly cared for;
• Home repairs have been done;
• Use in commercial, rental, teaching or instructional program or activities;
• Any product determined to have been taken over jumps, rails, ramps, and other hard objects will be void of any warranty.
This includes damage caused by:
– Misuse or an accident such as dock slides;
– Dock or beach starts;
– Striking a solid object, tow rope handle striking product, etc.; There are no exceptions to this rule.

DISCLAIMER OF WARRANTIES AND LIMITATION OF LIABILITY
DS.1 Nothing in these Terms and Conditions shall exclude or limit liability of Boardside.lv with regard to any matter for which it would be unlawful for us to limit or exclude our liability.
DS.2 Boardside.lv does not assume any liability arising out of or related to these Terms and Conditions for any loss of use, lost or inaccurate data, lost profits, failure of security mechanisms, interruption of business, costs of delay, or any indirect, special, incidental or consequential damages of any kind, even if Boardside.lv have been informed of the possibilities of such damages in advance.
DS.3 Boardside.lv accepts liability for death or personal injury caused by our actions or omission or by that of our employees and agents. We do not seek to limit liability for: 1) death, personal injury or loss of property caused by deficient goods; 2) harm caused by malicious intent or gross negligence or fraudulent misrepresentation by us or our employees or agents; 3) losses caused by our failure to rectify the non-conformity of goods; 4) concealed or hidden defects or the absence of alleged product characteristics. If we breach these Terms and Conditions, we shall only be liable for losses which are a reasonably foreseeable consequence of such breach.
DS.4 Boardside.lv is not responsible for indirect losses which are a side effect of the main loss or damage, for example loss of profits or loss of opportunity; or for failure to deliver the goods or to meet any of our other obligations under these Terms and Conditions if such failure is due to an event that is beyond our reasonable control, which includes but is not limited to fire, flood, storm, riot, civil disturbance, war, pandemic, nuclear accident and terrorist activity.
DS.5 Boardside.lv shall not be liable for non-execution or partial non-execution of the obligations undertaken hereof if it is caused by extraordinary circumstances, which could not have been foreseen, prevented or eliminated by any means (force majeure circumstances). In such case, the execution period of our obligations as per these Terms shall be extended until force majeure circumstances are no longer a factor.
DS.6 Maximum liability to the Buyer for any loss or damage arising in connection with the Buyer's order on our website is limited to the total price of the Buyer's order.

OWNERSHIP OF RIGHTS
OR.1 SIA ENTER DIZAINS / Boardside.lv retain all rights, title and interest in our Intellectual Property included on our Website. No ownership rights and/or Intellectual Property licenses are transferred to the Buyer, regardless of the use of terms such as “purchase” or “sale”. Our Intellectual Property may be used by third parties only if a written approval has been acquired from SIA ENTER DIZAINS / Boardside.lv prior to any such use.
OR.2 All trademarks, trade names, logos or other words or symbols identifying Boardside.lv are and will remain the exclusive property of SIA ENTER DIZAINS / Boardside.lv.

ADDITIONAL INFORMATION:
Wetsuit & Neoprene Accessories Care • When cleaning a wetsuit or other neoprene products, hand wash it in cool, fresh water and hang to air dry, out of direct sunlight, after every use;
• Light soap is okay to use when washing;
• After contact with saltwater or salt air, always rinse and dry textile products thoroughly, and lubricate metal parts when needed;
• When hanging to dry, avoid hanging by shoulders as we recommend it to be folded over a bar or hanger at the waistline;
• Under no circumstances should neoprene boots and gloves be turned inside out when drying;
• Whenever possible, store dry wetsuits on a hanger and avoid folding them;
• NEVER put your suit in a washing machine or dryer (not even tumble dry). This will cause your suit to shrink and stiffen;
• Avoid exposure to harsh detergents of chemicals. Chlorine and sunlight will cause fading to fabric;
• Do not use excessive force and fingernails when putting on or removing your wetsuit. Avoid contact with sharp objects and abrasive surfaces. If necessary, consult dealer to learn how to put on and remove wetsuit;
• Proper use and maintenance will prolong the lifespan of the product;
• You must stop using the equipment immediately upon noticing any damage. Damaged gear must be repaired immediately - dried out and delivered for professional repairs;
• If you have any doubts about the dependability of your gear, check and repair it at your local shop.
Kite-Wake-Surf Board Equipment Care
• Under no circumstances should the product be waxed, painted or altered in any form;
• Clean only with water, rinse thoroughly;
• Dry out regularly and thoroughly in room temperature;
• Colors will fade when subjected to prolonged sunlight exposure. Fading is not covered under warranty;
• Store your ski/board/boots/kite/wing/harness in a bag when not in use. Sunlight also deteriorates adhesive and all other materials;
• No watersports equipment is suited to be heated or dried by use of heat. Damage incurred in such a way will void the warranty;
• A visual inspection of the equipment must be carried out before each use. If damage is found, the equipment must not be used;
• Every time the equipment is impacted against another object, it must be immediately visually inspected. If damage is found, it must not be used without professional repair.
